Conrad O’Brien routinely handles actions arising out of business and insurance transactions. These can range from simple breach of contract claims to complex multi-party multi-million dollar disputes. We also handle a wide range of civil RICO cases, including, for example, actions arising out of the provision of health care services, the sale of media rights, the distribution of specialty products, and the use of environmental resources. With respect to RICO claims in particular, our lawyers include several former Assistant U.S. Attorneys who have collectively handled numerous criminal RICO actions. Drawing on that experience, we are well prepared to investigate and develop cases involving complex financial and commercial transactions.

Representative cases include the following:

• Conrad O’Brien is co-lead counsel for a leader in the digital wireless communications industry, in a suit brought by a wireless semiconductor supplier in the United States District Court for the District of New Jersey. The suit alleges federal antitrust claims, as well as state and common law claims, against the firm’s client based on its alleged activities in connection with various industry standards-setting organizations, and in connection with the licensing of its intellectual property and products.
• Conrad O’Brien represented an international chemical company seeking insurance recoveries for environmental liabilities at Superfund and other sites around the country. We handled jury and non-jury trials and appeals in Pennsylvania and New Jersey, and ultimately recovered more than $300 million for the client.
• Conrad O’Brien represented a general contractor seeking insurance coverage for wrongful death and personal injury claims arising out of a serious construction accident. On motions for summary judgment, the court ruled that the contractor had coverage under two liability insurance policies, each in the amount of $25 million. These rulings were instrumental in settling more than 30 cases that had been filed concerning the accident.
• Conrad O’Brien represented an international information technology company in a complex contractual dispute concerning a major contract with the Department of Defense. We defeated plaintiff’s efforts to obtain a Temporary Restraining Order to preclude the company from continuing to perform the contract, and then obtained a complete dismissal of the plaintiff’s seven count complaint.
• Conrad O’Brien represented an international information technology company in a dispute with a major client and a subcontractor over a multimillion dollar hardware/software design and installation contract. The subcontractor filed a complaint against the company in Illinois. We worked with the company to assess its exposure and potential claims against the subcontractor and its surety, and assisted in achieving a settlement. The subcontractor voluntarily dismissed its complaint before any further litigation proceedings were necessary.
• Conrad O’Brien represented a market leader in the sale of wastewater treatment chemicals in a Pennsylvania state court action in defense of claims alleging that the company had tortiously interfered with a consultant’s ability to secure work in the industry. After a week of trial, the court found that plaintiff had not proved his case and entered a non-suit, dismissing the case in favor of our client.
• Conrad O’Brien represented an insurance company which was subject to an $11 million confessed judgment in the Philadelphia Court of Common Pleas. We were successful in moving to strike the judgment and then in sustaining the result on appeal.
• Conrad O’Brien represented a federally appointed Receiver in recovering over one million dollars from a national bank for purposes of funding a Consumer Restitution Program for victims of a nationwide telemarketing fraud. We continue to represent the Receiver in the administration of the Restitution Program.
