Biography 

Francesco (Frank) focuses his practice on complex commercial litigation, with a particular focus on business and insurance matters. 

Prior to joining Conrad O’Brien, Frank served as an associate at Dechert LLP, where he defended clients in civil RICO litigation, antitrust cases, product liability cases, and appellate litigation.

Representative Matters include the following:

  • Currently representing federally-appointed Receiver in recovering assets and maximizing recovery for defrauded investors in connection with a civil action by the Securities and Exchange Commission alleging various securities violations arising out of fraudulent investment activity in the nature of a Ponzi scheme.
  • Currently representing insurer in consumer class action in several states alleging insurer’s failure to provide statutorily mandated discounts in the sale of automobile insurance policies.
  • Representation of the respondent in Schwab v. Reilly, an action before the United States Supreme Court challenging the government's interpretation of a U.S. Trustee's duty to object to exemptions under the Bankruptcy Code.
  • Representation of petitioners in Milavetz v. United States, an action challenging the validity of portions of BAPCPA on First Amendment grounds in the United States Supreme Court.
  • The defense of the estate of J. Howard Marshall (the deceased husband of the late Vickie Lynn Marshall, a.k.a. Anna Nicole Smith) from claims brought by Vickie Lynn Marshall's estate in the Ninth Circuit Court of Appeals and before Justice Kennedy sitting as Circuit Justice.
