Biography
Tyler Graden began his legal career as an investigator with the Chicago District Office of the U.S. Equal Employment Opportunity Commission, where he investigated and resolved individual and systemic claims of discrimination. Prior to joining the firm, Tyler successfully headed an investigation on behalf of the EEOC into the discriminatory employment practices of a nationwide clothing chain which led to a $50 million consent decree. Tyler continues to devote a substantial portion of his practice to employment-related matters, including representation of large and small businesses in connection with agency investigations, ERISA matters, internal compliance, employment contracts, and employer negligence matters. Tyler’s other practice areas include representation of businesses and professionals in contract disputes, legal and medical malpractice actions, products liability cases, environmental litigation and white collar criminal defense.
Representative Matters include the following:
- Obtained, in the Philadelphia Court of Common Pleas, dismissal for Korean manufacturer on grounds that maintenance of a website with worldwide access is not alone sufficient to establish personal jurisdiction in Pennsylvania.
- Defended Fortune 500 Company, in the New Jersey Superior Court of Camden County, in multi-party environmental action brought under the New Jersey Spill Compensation and Control Act (“Spill Act”), N.J.S.A. 58:10-23.11, et seq., seeking costs associated with the cleanup and remediation of a former landfill.
- Pursued claim on behalf of an independent contractor, in the Pennsylvania Court of Common Pleas of Dauphin County, after a municipal authority prematurely terminated the contractor’s employment.
- Ongoing representation of lender in million dollar construction loan litigation pending before the Superior Court of New Jersey in Cape May County, Equity Division, and the Gloucester County, Law Division.
- Litigated Section 1983 civil rights claim, in the United States District Court for the Eastern District of Pennsylvania, on behalf of a prisoner seeking compensation under the Eighth Amendment for cruel and unusual punishment.
- Defended a spice supplier, in the Philadelphia Court of Common Pleas Compulsory Arbitration Program, in litigation arising from a third party carrier’s failure to timely deliver, and loss of, products.
- Represented a chocolate manufacturer, in the United States District Court of the Western District of Pennsylvania, in a breach of contract action.
Tyler has also worked in the legal department of a Fortune 500 company, and prosecuted cases on behalf of the Philadelphia District Attorney’s Office through Temple’s clinical program. Prior to embarking on his legal career, Tyler worked on the floor of the Chicago Mercantile Exchange, taught English in Japan, and interned at the American Chamber of Commerce in Moscow, Russia. Tyler continues to enjoy foreign travel and has recently spent time absorbing the culture and history of Nicaragua and Guatemala.
