Biography
Robert Rauker is one of the leading patent attorneys in the Delaware Valley. Prior to joining Conrad O’Brien, for over a decade, Bob served as either Chief or Senior Patent Counsel to two major multi-billion dollar medical device and scientific companies. Before going in-house, Bob was an associate specializing in IP litigation with a major Midwestern law firm. From 2004-2008, Bob was Vice President, Global Chief Patent Counsel for Synthes, Inc, a leading $3 billion dollar global medical device company, headquartered in West Chester, Pennsylvania. While at Synthes, he successfully managed multiple patent infringement suits around the world and created the company’s first-ever global intellectual property department, whose purpose was to improve the current and future value of the company’s intellectual property, while also implementing cost-containment measures. Today, Bob provides clients with sophisticated assistance in the areas of patent infringement litigation and trade secret protection, while also counseling clients on strategic patenting initiatives, IP opinions, due diligence and patent portfolio evaluations. In addition, he has significant experience in negotiating and drafting agreements involving intellectual property including licenses, acquisition, development, and consulting arrangements. Bob’s 15 years of experience in the medical device industry provides him with a unique ability to evaluate and counsel clients on the impact of FDA rules and regulations regarding the acquisition, licensing and development of intellectual property.

- Represented corporation by managing patent infringement action through appeal briefing and arguments at the Court of Appeals for the Federal Circuit resulting in a favorable settlement for the client.
- Represented corporation by managing patent infringement action through appeal briefing and arguments at the Court of Appeals for the Federal Circuit resulting in a favorable settlement for the client.
- Represented corporation by managing multi-faceted trade secret case involving former employees that resulted in a multi-million dollar positive settlement.
- Represented corporation by managing patent infringement action in Germany that resulted in a finding of infringement and injunction against the competitor.
- Represented corporation in trademark infringement action in federal district court in Minnesota, resulting in favorable settlement for the client after summary jury trial.
- Represented corporation in patent infringement action in federal district court in Minnesota, resulting in finding of infringement by competitor of client.
- Represented corporation by directing the filing of re-examination requests of patent that resulted in a successful stay of pending litigation involving the same patent.
- Represented corporation by managing patent infringement action whereby client was initially named as defendant, but case eventually settled with plaintiff making multi-million dollar payment to end case.
- Represented clients in well over 100 diligences, negotiations and closings involving a wide variety of technology ranging from software to medical devices and valuations exceeding $800m.
- Prepared program and subsequently trained several hundred employees of clients to increase knowledge and reduce risk exposure in all facets of IP, including, trade secrets, non-competition agreements, confidentiality agreements, diligence, copyrights and trademarks.
- Prepared strategic cost-benefit analysis of patent portfolios for clients resulting in millions of dollars in savings.
- Evaluated numerous patent and trade secret portfolios on behalf of client for purposes of potential acquisition or license; Drafted subsequent opinions regarding valuation of portfolios.
