Biography

Deborah J. Krabbendam focuses her practice on the litigation and appeal of complex commercial cases, as well as the parallel criminal and investigative matters that often arise. She has been with the firm since 1986, and she draws on her broad experience to help clients develop innovative approaches to a range of knotty issues.

Deborah represents a global technology company in a variety of matters, including a breach of contract dispute arising out of a multimillion dollar hardware/software design and installation contract. She represents both companies and individual clients in litigation and government or internal investigations pertaining to the False Claims Act, other laws governing transactions which directly or indirectly implicate the public sector, and the securities laws. Her services to clients include providing advice and representation on insurance coverage issues.
Deborah also represents insurance companies in a wide range of class actions. In one such case, a Minnesota federal court dismissed claims under a state statute mandating insurance discounts for cars with qualifying antitheft devices, and an appeal is pending in the Eighth Circuit. In a similar case filed in Pennsylvania, motions for summary judgment and class certification are pending. In cases alleging abusive practices and misrepresentation in the sale of universal and variable universal life policies, Deborah and her Conrad O’Brien colleagues defeated class certification, secured dismissal, and obtained summary judgment in the client's favor. They achieved similar successes in nationwide consumer class actions alleging inadequate disclosures or omissions relating to modal premium charges: two cases were dismissed after initial motion practice; and a third was settled on terms very favorable to the client after plaintiffs agreed to limit a nationwide class action to one state.

In the fall of 2011, Deborah presented What Every Transactional Lawyer Needs to Know About Doing Business With the Public Sector, DELVACCA 2011 In-House Counsel Conference (September 2011).
